Dear Mr. Johns,
This letter is to follow up with you concerning your June 15, 201 0 letter from your attorney, Kevin P. Markey. Although I am not an attorney, I did consult with our Brunswick legal department in order to respond to some of the issues outlined in your attorney's letter.
Our company would like to specifically address Mr. Markey's question of "whether the installation of a SeaLift product (hydraulic platform) on our vessels 'automatically1 voids the manufacturer's hull warranties. Sea Ray does not intend to automatically void the applicable Express Limited hull warranties merely by virtue of SeaLift installing an "after-market" part or piece of equipment. However, we believe that it is important to clarify several points:
Sea Ray's limited warranties do not cover the actual SeaLift product installed onto the boat. Our warranties also contain specific limitations that could pertain to SeaLift's products and installation of those products. For example, the Sea Ray Sport Boat Express Limited Warranty states that the warranty does not apply to the following items:
• Engines and stem drives, controls, propellers, batteries, trailers or other equipment or accessories
which are not installed by Sea Ray or which carry their own individual warranties.
• Any Sea Ray boat which has been altered or modified from Sea Ray factory specifications.
• Any failure or defect caused by an accident, product abuse, or misuse.
• Failure of the owner to use, maintain, or store the boat as specified in the Sea Ray owner's manual;
and any other failure to provide reasonable care and maintenance.
• Any failure or defect arising from a previous repair made by a non-authorized service provider,
unless said repair was preapproved by Sea Ray.
• Any modifications to a Sea Ray Boat based on design or manufacturing changes, or standard
options, accessories or warranties added, improved, or revised from previous Sea Ray Boats.

With regard to the Magnuson Moss Warranty Act, Sea Ray is not conditioning its warranty on the use of certain products or service providers. The law does not require manufacturers to provide a warranty for damage caused by a modification to the boat or by others' improper or incorrectly installed equipment. For example, if SeaLift installs a lift which damages the boat or causes it to malfunction, Sea Ray's warranty would not cover the resulting damage and Sea Lift would be responsible for such damages.
